Your rights as a data subject

The General Data Protection Regulation has expanded the rights for you as the owner of your data. Some of these rights already existed, but have been tightened.

Right to information about the processing

Organizations are obliged to inform the public about their data processing. You have the right to know what happens to your data and why. And this applies to every new processing. Commaxx BV informs you when (new) data is collected. This can also be done in the form of information on our website. Only if it has been established that you have already been informed, for example by an email to an email address you provided, we are not obliged to inform you.

Right of access and rectification

As the owner of your data, you can ask us whether your personal data is processed automatically and what data it concerns. You are not obliged to explain the access request. In addition, a parent or legal representative may submit a request for access for children up to the age of 16. Offline data also applies to the right of inspection, with the exception of data from documents that have already been stored in an archive storage facility.

You also have the right to ask us to adjust, supplement, delete or shield data if it is factually incorrect, incomplete, irrelevant or if it is used or collected in a way that is contrary to the law.
We must also pass this on to third parties acting on behalf of Commaxx BV work with your data, and we will of course inform you as the data subject about this.

Right to be forgotten

The right to be forgotten is no longer limited to the removal of objectively incorrect data, incomplete data or data that is no longer relevant.

You may have your personal data deleted if:

-       The data is no longer necessary for the purpose for which it was collected or processed.

-       If you withdraw your consent to processing or lodge an objection.

-       We have processed your data unlawfully.

-       Your data must be erased based on a rule of Union or national law.

-       When it concerns data from children under the age of 16.

Of course, we will also pass on your request to third parties who work with the data on our behalf, and of course also to you as the data subject.

Right to object

You may request us to no longer use your personal data. We call this the right to object. For example, if we use your data for marketing purposes, but also for special personal reasons, such as in the event that you do not want someone you know who works for us to be able to view your 'sensitive' data.

Right to data portability

The right to transferability, data portability, means that personal data must be easy to transfer, for example if you want to switch. A consumer may ask an organization to transfer his digital personal data directly. This only concerns digital personal data that has been collected and processed with or without your consent. We are required to provide the data in a form that can be easily reused by another organization.

Rights of data subjects in profiling

Profiling is another word for the automated processing of personal data. You do not have to participate in profiling for marketing purposes. For example, a profile of you can be created based on collected information, which can be used to predict your purchasing behavior. For example, we can email you specific offers based on your profile. If you do not appreciate this, you can object. We are obliged to immediately cease processing the data for direct marketing.

Withdrawal of consent

In the context of the General Data Protection Regulation, we will regularly inform you about our data processing. And we are now also obliged to ask you for permission in advance. Also, a page where we ask you for permission and where we have already checked permission in advance is no longer legally valid. You have to check the box yourself, either Commaxx BV actively consent to a specific action or processing of your personal data. For the GDPR, such a so-called pre-ticked box was sufficient. And you are free to withdraw your consent.

If you have any questions or would like to exercise any of the rights, please email support@lenco.com or use the contact form on our website.
